*Time to Take the Chinese Threat Seriously*
For nearly half a century, dreamy Westerners have seen Red China as a
potential pot of cold. Trade, however, with China has often been very
difficult. The Chinese are stingy about opening their markets to our goods
-- except raw materials. They dump cheap junk on North American markets
and, due to "free trade" and lack of protective tariffs drive Canadian and
U.S. manufacturers out of business and cause the transfer of North American
jobs to China.
Now, they come as major investors. They want a key foothold in many of our
strategic industries. As far back as 1997, a joint Canadian Security
Service (CSIS) RCMP report, called The Sidewinder Report,(which a terrified
Liberal government sought to repress) warned about Chinese infiltration of
key Canadian industries.
China has a sense of destiny as "The Middle Kingdom" -- a somewhat
ethnocentric "we are the centre of the world" -- and would like to
reestablish Asian hegemony and perhaps even world hegemony. There are large
Chinese populations in many Western target counties, including Canada, the
U.S. and Australia. Many of these people maintain a staunch ethnic
solidarity.
The Asian Pacific Foundation of Canada report shows a huge trade deficit
in our trade with China -- a deficit of $31.756-billion of 2011 and a
deficit of $23.6-billion for the first nine months of 2012.

CHINESE MINERS ALLOWED TO COME TO B.C., AND KEEP CANADIANS JOBLESS,
JUDGE RULES

Canadian workers are screwed once again and the heartless importation
of cheap temporary foreign, in this case, Chinese workers in place of
unemployed Canadian miners can continue, according to a ruling by
Federal Court Judge James Russell.

CBC News (December 14, 2012) reports: "A federal judge will not grant
an injunction to stop Chinese workers from coming to Canada to work at
a new coal mine in northern B.C., because the company and workers
followed all the necessary rules.The ruling means more than 200
Chinese mine workers who were hired to do specialized work at the
underground mine in Tumbler Ridge will be able to come to Canada on
temporary work permits.

ABOUT A DOZEN OF THOSE WORKERS HAVE ALREADY ARRIVED IN TUMBLER RIDGE
AND ARE STUDYING ENGLISH AT THE LOCAL COLLEGE. THE INTERNATIONAL UNION
OF OPERATING ENGINEERS AND THE CONSTRUCTION AND SPECIALIZED WORKERS'
UNION WERE SEEKING AN INJUNCTION TO STOP THE REST OF THE WORKERS FROM
ARRIVING, WHILE THEY FIGHT FOR A JUDICIAL REVIEW OF ALL THE TEMPORARY

RUSSELL ALSO SAID THAT THE UNIONS' CASE WAS SPECULATIVE AND DID NOT
CLEARLY PROVE THAT THE IMMINENT ARRIVAL OF THE 60 CHINESE WORKERS
WOULD CAUSE "IRREPARABLE HARM."
"I HAVE NO WAY OF QUANTIFYING THAT LOSS EITHER FOR ANY INDIVIDUAL OR
COLLECTIVELY," HE WROTE, SAYING THE UNION FAILED TO PROVIDE CLEAR AND
CONVINCING EVIDENCE THAT THERE ARE CANADIAN MINERS WHO ARE WILLING,
ABLE AND QUALIFIED TO CARRY OUT THE WORK THE CHINESE MINERS HAVE BEEN
HIRED TO DO.
THE COMPANY ISSUED A STATEMENT SAYING THE DECISION WAS A VICTORY THAT
TOTALLY VINDICATED ITS DECISION TO HIRE THE MINERS.
"HD MINING HAS A VERY STRONG REPUTATION WITH THE COMMUNITY OF TUMBLER
RIDGE, AND WE ARE RIGHT NOW PROVIDING EMPLOYMENT TO MANY CANADIANS AT
THE SITE, DIRECTLY OR THROUGH CONTRACTORS," HD MINING CHAIR PENGGUI
YAN SAID IN A STATEMENT ON FRIDAY.
"THERE ARE HUNDREDS OF THOUSANDS FOREIGN WORKERS WORKING UNDER THIS
PROGRAM IN CANADA TODAY AND WE DO NOT UNDERSTAND WHY THE UNIONS WOULD
TRY AND SHUT DOWN OUR PROJECT. HOW WOULD THAT PROVIDE JOBS FOR
ANYONE?"

Chinese miners allowed to come to B.C., and keep Canadians jobless, judge
rules

are studying English at the local college. The International Union of
Operating Engineers and the Construction and Specialized Workers' Union
were seeking an injunction to stop the rest of the workers from arriving,
while they fight for a judicial review of all the temporary work permits.

The unions want the Federal Court to overturn Ottawa's

allow HD Mining International to bring the workers in from China. Last
month Human Resources Minister Diane

the Conservative government isn't satisfied HD Mining followed all the
rules when it sought foreign worker permits for its proposed mine near
Tumbler Ridge. Judge James Russell said that HD Mining properly followed
the rules when applying for its foreign worker permits. 'We have 60 workers
who are all but on their way and who have acquired all that our system says
they need to come to Canada,' he wrote in his ruling."

Following the rules? Really? "Labour unions have raised concerns that job
ads posted on the government of Canada’s job bank last year listed speaking
Mandarin as an asset.<http://www.cbc.ca/news/canada/british-columbia/story/2012/10/23/bc-mine-chinese-workers.html>|"
English, certainly, French,perhaps, as a language requirement, but Mandarin
to mine coal in Canada? Outrageous. These requirements were clearly a ruse
to avoid hiring unemployed Canadians, miners and otherwise trainable able
bodied workers, and thus justify a request to import temporary foreign
workers.

Further, "the B.C. Federation of Labour says documents show it will be 14
years before Canadians

the temporary foreign workers."



HD Mining is a majority controlled Chinese company. Its eagerness to import
Chinese foreign workers and keep Canadians unemployed should be a hammer on
the head warning to the federal government against allowing the Chinese to
buy into the Canadian economy.



One wonders whether Mr. Justice Russell would be quite so blase if Canada
were importing temporary Chinese judges for seats on the very cushy and
well paid federal bench?

Luckily, the union challenge to the cruel importation of foreign miners
when so many Canadians -- officially 7.3% of the work force -- are
unemployed continues in another venue. The CBC reports: "In the meantime, a
judicial review is underway after the unions won a victory in
court<http://www.cbc.ca/news/canada/british-columbia/story/2012/12/10/bc-tumbler-ridge-miners.html>last
week forcing the company to hand over all the paperwork from their
recruiting campaign, including ads the company ran trying to recruit
Canadians. ... The judicial review process is expected to take two or three
months."

collectively," he wrote, saying the union failed to provide clear and
convincing evidence that there are Canadian miners who are willing, able
and qualified to carry out the work the Chinese miners have been hired to
do.

The company issued a statement saying the decision was a victory that
totally vindicated its decision to hire the miners.

"HD Mining has a very strong reputation with the community of Tumbler
Ridge, and we are right now providing employment to many Canadians at the
site, directly or through contractors," HD Mining chair Penggui Yan said in
a statement on Friday.

"There are hundreds of thousands foreign workers working under this program
in Canada today and we do not understand why the unions would try and shut
down our project. How would that provide jobs for anyone?"
Judicial review expedited

In the meantime, a judicial review is underway after the unions won a
victory in court<http://www.cbc.ca/news/canada/british-columbia/story/2012/12/10/bc-tumbler-ridge-miners.html>last
week forcing the company to hand over all the paperwork from their
recruiting campaign, including ads the company ran trying to recruit
Canadians.

Labour unions have raised concerns that job ads posted on the government of
Canada’s job bank last year listed speaking Mandarin as an

They are also worried that HD Mining might try to bring the rest of the
miners to Canada ahead of schedule in order to render the judicial review
moot.

But the Judge argued that this was unlikely, considering the costs involved
and the fact that the company is now under scrutiny both by the media and
the government.

The judicial review process is expected to take two or three months.

The B.C. Federation of Labour says documents show it will be 14 years
before Canadians
replace<http://www.cbc.ca/news/canada/british-columbia/story/2012/12/12/bc-chinese-miners-documents.html>all
the temporary foreign workers.

On Thursday, one of the miners already in Canada filed a human rights
complaint<http://www.cbc.ca/news/canada/british-columbia/story/2012/12/13/bc-chinese-miners-human-rights-complaint.html>alleging
content on the United Steelworkers union website is likely to
create contempt for Chinese people.
