*The Richard Warman Record* ** *A foreign journalist recently wrote me for a background on complaints filed by Richard Warman. As I began to knock off what I thought would be a quick answer, I realized that I was working on a ponderous compendium. Here is my answer.* ** *Paul Fromm* *CANADIAN ASSOCIATION FOR FREE EXPRESSION * *FILING COMPLAINTS UNDER SEC. 13 (INTERNET CENSORSHIP) OF THE CANADIAN HUMAN RIGHTS ACT* Warman filed Sec. 13 complaints under the Canadian Human Rights Act for postings on the Internet against: * Marc Lemire and the Freedomsite (website) * Fred Kyburz * Alexan Kulbashian and the Tri-City Skins * Eldon Warman * Glen Bahr and Western Canada for Us * Al Kouba * Jessica Beaumont * Ciaran Donnelly * Terry Tremaine * Bobby James Wilkinson * Tom Winnicki * Melissa Guille and the Canadian Heritage Alliance * Jason Ouwendyk and the Northern Alliance *(this is a partial list)* *FILING LIBEL SUITS AGAINST CRITICS* Warman filed libel suits, usually for calling him a "censor" or criticizing his anti-free speech activities against: * David Icke, British New Age conspiracy commentator, for comments he made about Warman in his book *Children of the Matrix*. A number of other defendants, including Ottawa monetaru critic Tom Kennedy, who had sold or marketed Children of the Matrix were added to this lawsuit. This action has meandered on for almost a decade and, we believe, is still at the discovery stage. A trial date will be set soon. * Paul Fromm and the Canadian Association for Free Expression -- found guilty; Warman awarded $43,00 judgement * Mark and Connie Fournier for postings on their website FreeDominion -- 3 separate libel suits -- ongoing * 7 "John Does" (people posting under pseudonyms) on Freedominion.ca. Most .of these have been identified -- ongoing * The* National Post*, Editor Jonathan Kay -- settled out of court * Ezra Levant (journalist and lawyer) for criticizing his anti-free speech activities -- ongoing * Jason Bertucci -- ongoing * Numerous medias outlets and individuals have been threatened with defamation suits * (this is a partial list)* *FILING CONTEMPT OF COURT COMPLAINTS THAT COULD LEAD TO THE VICTIM BEING JAILED* Warman filed complaints of "contempt for court"; that is; failure to obey a vague "cease and desist" gag order issued by the Human Rights Tribunal against a victim after a successful Sec. 13 prosecution by Warman * against Tom Winnicki, who was sentenced to 9 months in jail * against Terry Tremaine \twice); the first complaint was adjourned sine die in July, 2009; the second charge led to Mr. Tremaine's acquittal in December, 2010; the Canadian Human Rights Commission is appealing this decision and the complaint wil be heard Sept. 19 in Vancouver *FILING "HATE" LAW COMPLAINTS* Warman filed complaints urging prosecution of "wilful promotion of hate" under Sec. 319 of Canada's Criminal Code * against Marc Lemire -- the police did not prosecute * against Alexan Kulbashian and the Tri City Skins - the police did not prosecute * against Tom Wininicki -- the police did not prosecute * against Glen Bahr -- he was charged; the charges were dismissed at preliminary hearing when lawyer Doug Christie argued double jeopardy citing the Wigglesworth decision in the Supreme Court of Canada * against Ciaran Donnelly and Jessica Beaumont; their home was raided; they were put out on the sidewalk in their pyjamas during the search; the police seized computers and CDS. No charges were laid. The computers were returned with their hard drives damaged and many of the CDs wrecked. * against Terry Tremaine; he was charged in 2008; he has been under a bail gag order, not allowing him to post on White Nationalist or National Socialist sites; a preliminary hearing went from Oct., 2009 to early 2011; the case has been bound over for trial in Regina, June, 2012 *(This list may also be incomplete.)* *GOING AFTER DISSIDENTS' EMPLOYMENT* Warman complained to Terry Tremaine's employer at the University of Saskatchewan in 2005, more than a year before the Canadian Human Rights complaint was adjudicated. He warned that he'd go to the press and police unless "appropriate" action was taken. Mr. Tremaine, then 57, lost his job and career as a math instructor, was reduced to poverty and was unable to hire an attorney to defend him in August 2006 against the Sec. 13 human rights charges. *TRYING TO REMOVE DISSIDENT'S MAILING RIGHTS* Warman filed a complaint with Canada Post against Eldon Warman of Calgary (one of his Sec. 13 targets) for receiving mail at his lady friend's post office box. Eldon Warman received a notice from Canada Post advising him that no mail would be delivered to him or his De-tax organization at that address. *APPLAUDING ASSAULT ON A DISSIDENT* * One of Warman's early targets was British New Age conspiracy writer David Icke. Warman was part of a nation-wide campaign involving B'nai Brith and others who sought to shut down Icke's author speaking tour of Canada early in the 2000s. A British documentary shows Warman joking with two goons who assaulted Icke by throwing a pie at him during a book signing at Duthie's bookstore in Vancouver. At least one complaint was filed about Warman's behaviour with the Law Society of Upper Canada, but the complaint was dismissed. THREATENING LIBRARIES FOR CARRYING DAVID ICKE's *CHILDREN OF THE MATRIX* In 2002 and 2003, Richard Warman threatened libel suits against a host of libraries in Ontario and British Columbia, demanding that they purge their shelves of copies of David Icke's book Children of the Matrix which he alleged defamed him. [This assertion had not then and has not yet been determined by a Court of Law.] Some libraries knuckled under; others hung tough. Eventually, British Columbia amended its defamation laws to make libraries exempt from libel actions flowing from the contents of the books they carry. MOT*IVES:* Warman delivered the keynote address to the August, 2005 meeting of the violence-prone Anti-Racist Action group in Toronto., Warman's address was entitled "Shutting down the neo-Nazis by (almost) any means necessary" and discussed his multi-level programme of complaints. He said, in part: *"'The 'maximum disruption' part comes in because wherever I think it will be most helpful, or even if I just feel it will be the most fun, I strongly believe in hitting the neo-nazis on as many of these fronts as possible either at the same time or one after the other. I say this because it keeps them off-balance and forces them to respond to things that focus their energies on defending themselves ...'* Then, came a chilling comment from Richard Warman, who, by our count filed over 20 Sec. 13 Internet complaints and many other complaints under the "hate law" and other pieces of legislation. CAFÉ has argued all along that Sec. 13 was being used for political purposes. The *Globe and Mail* (March 19, 2011) reported: Richard “Warman has sparked 16 Canadian Human Rights Tribunal civil cases {Sec. 13]. .. ‘*The goal was to knock out a generation of the neo-Nazi leadership and the worst offenders, establish a solid body of case law, and show the Internet was not the Wild West*.” These are his stated motives but they seem contradictory and unconvincing. At the very least, Warman casts a wide net in defining "neo-Nazis." It must be noted that Warman's victims have included the Fourniers. They and most of their circle at Freedominion are strong supporters of Israel -- a rather odd form of "neo-Nazi." Ezra Levant is right of centre. perhaps a bit libertarian and a supporter of free speech. Again, it's hard to see him as a Jew and Zionist as being some sort of "neo-Nazi." Indeed, only two of Warman's victims (the obscure Bill Wilkinson and Terry Tremaine) even identify themselves as National Socialists. In 2007, Warman received the Saul Hayes Award from the Canadian Jewish Congress for his "human rights work" in filing|"hate" complaints about Internet users.. Earlier, he contributed a significant section to the 2005 B'nai Brith Annual Audit of nti-Semitic Incidents. Free speech supporters have been repeatedly thwarted at tribunals from discovering how much he was paid for his writing and report. |
